By using IntuEstate (the "app"), you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the app. These terms apply to everyone who visits the app, including people who only browse listings.

The app is a real estate search, analysis, and client-management tool used by the licensed agent or brokerage identified in the app. Using the app does not by itself create an agency, brokerage, or fiduciary relationship with us or with any agent. A representation relationship begins only when you and an agent sign a written agreement. All brokerage services are provided by the licensed brokerage named in the app.

You must be at least 18 and able to enter a binding contract. Keep your login credentials private and accurate, and tell us promptly if your account is used without your permission. You are responsible for activity under your account. Agent and team accounts may access additional tools and client records, and must use them only as their brokerage and the law allow.

• Use the app for personal home search, or for your own legitimate real estate business if you are a licensed agent.
• Do not scrape, copy, resell, or redistribute listing data, or use automated tools to pull data from the app.
• Do not attempt to access another person's account or client records, or interfere with the app's operation.
• Do not upload unlawful content, or use the app to send spam or harassing messages.

Listing data comes from participating MLS and IDX sources and is for personal, non-commercial use only. It is deemed reliable but not guaranteed, may be delayed, and can change or be withdrawn without notice. Measurements, acreage, school assignments, taxes, HOA fees, and property records are approximate and must be independently verified. You agree to follow any additional MLS or IDX data-use terms shown in the app.

Automated valuations, comparables, price-per-square-foot and price-per-acre figures, seller net sheets, rent estimates, infill scores, and future land-use designations are informational estimates only. They are not appraisals, not a guarantee of value or of what a property will sell or rent for, and not financial, legal, or tax advice. Consult a licensed appraiser, lender, attorney, or tax professional before making decisions.

You agree to use the app in compliance with the Fair Housing Act and all applicable federal, state, and local fair housing laws. You may not use search tools, saved searches, client records, or messaging to express a preference, limitation, or discrimination based on race, color, religion, sex, disability, familial status, national origin, or any other protected characteristic.

When you submit a request or check a consent box, you consent to be contacted by phone, text, or email about your inquiry, including by autodialed or prerecorded means. Consent is not a condition of buying, selling, or making an offer. Message and data rates may apply. You can opt out at any time by replying STOP, using an unsubscribe link, or contacting the agent.

You keep ownership of what you upload or send. You give us permission to store and use it to provide the service, for example sharing your showing request with your agent or filing a document to your transaction. Do not upload anything you do not have the right to share.

The app links to and relies on services we do not control, including MLS and IDX data feeds, county and city record systems, mapping, email and text delivery, and e-signature providers. Their terms and privacy policies apply to their services, and we are not responsible for their content or availability.

The app's design, software, market analytics, written content, and branding are ours or our licensors' and are protected by intellectual property law. You may not copy or reuse them without written permission. Listing photos and remarks belong to their respective owners and MLS.

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and non-infringement. We do not warrant that listings are available, complete, current, or error-free, or that the app will be uninterrupted.

To the fullest extent permitted by law, we and the brokerage are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, or decisions made in reliance on the app's estimates. Our total liability for any claim relating to the app is limited to one hundred dollars ($100).

You agree to indemnify and hold us and the brokerage harmless from claims arising out of your misuse of the app, your violation of these terms, or content you provide.

We may suspend or close an account that violates these terms, breaks MLS or data-use rules, or creates legal risk. You may stop using the app and delete your account at any time from account settings.

These terms are governed by the laws of the State of Arkansas, without regard to conflict of law rules. Disputes will be brought in the state or federal courts located in Arkansas, unless applicable law requires otherwise.

We may update these terms; the date above shows the current version, and continued use after an update means you accept it. Questions about these terms can go to the agent or brokerage listed in the app footer or contact panel.
